GENERAL RAFFLE RULES AND REGULATIONS

The following rules govern participation in the West Virginia State Parks Foundation Adventure Raffle (“Raffle”). By purchasing or receiving a raffle ticket, each participant agrees to be bound by these rules and all applicable federal, state, and local laws and regulations. Raffle License #2502-6767

1. Sponsor

The Raffle is sponsored and conducted by:

The organization is responsible for administering the Raffle, selecting the winner(s), and distributing the prize(s) in accordance with these rules.

2. Eligibility

1. The Raffle is open to individuals who meet all eligibility requirements established by the Sponsor and applicable law.
2. Participants must be 18 years of age or older.
3. Employees, officers, directors, of the West Virginia State Parks (Statewide) Foundation and other individuals prohibited from participating under applicable law may not participate.
4. The Sponsor reserves the right to verify the eligibility of any participant or potential winner.
5. Participation is void where prohibited or restricted by law.

3. Raffle Tickets

1. Each raffle ticket constitutes one entry into the Raffle, unless otherwise specified.
2. Tickets may be purchased for $40 per ticket or buy 5 get the sixth free.
3. Tickets must be purchased by stated drawing announcement deadline to be eligible.
4. Lost, stolen, damaged, illegible, or destroyed tickets are the responsibility of the purchaser. The Sponsor may, in its discretion, determine whether a ticket can be verified through its records.
5. Tickets may not be reproduced, altered, counterfeited, or transferred except as expressly permitted by the Sponsor and applicable law.
6. The person identified on the ticket or in the Sponsor’s official ticket records will generally be considered the owner of the entry.

4. Ticket Sales

Tickets may be purchased through methods authorized by Sponsor.

All ticket purchases are subject to applicable laws and regulations. The Sponsor reserves the right to refuse or cancel a transaction that does not comply with these rules or applicable law.

5. Drawing

1. The drawing will be held on January 23, 2027, at a time to be announced, at the West Virginia Hunting and Fishing Show held at the Charleston Civic Center, Charleston, WV.
2. The winner will be selected at random from all eligible entries received by the deadline.
3. The drawing will be conducted using a method determined by the Sponsor that is intended to provide a fair and impartial selection.
4. The odds of winning depend upon the number of eligible entries received.
5. The Sponsor’s determination regarding the validity of entries and the selection of the winner shall be final, subject to applicable law.

6. Winner Notification

1. The potential winner will be notified using the contact information provided with the winning entry. The potential winner shall be required to provide proof of identity, age, eligibility, SSN, and/or ownership of the winning ticket before the prize is awarded. Note State code: West Virginia Code §47-21-22 requires licensees to report the name, address and social security number of any individual who received prizes which valued in the aggregate more than one hundred dollars during the course of any raffle occasion. Failure to report this information, or reporting fraudulent information, may subject the licensee organization to administrative or criminal penalties. Note, completion of a form will be required for these purposes
2. If the potential winner cannot be contacted within 30 days, fails to provide required documentation, is determined to be ineligible, or otherwise fails to comply with these rules, the Sponsor may select an alternate winner.
3. The Sponsor is not responsible for a winner’s failure to receive notification because of incorrect, incomplete, or outdated contact information.

7. Prize

The prize is:

The approximate retail value of the prizes is specified in marketing information.

1. The prize becomes the property of the winner, and is transferable, but may not be substituted for cash.
2. The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
3. Any taxes, fees, licenses, insurance, registration costs, or other expenses associated with accepting or using the prize are the responsibility of the winner.
4. The winner is responsible for complying with all applicable laws, rules, restrictions, and requirements associated with the prize.
5. Prizes may be combined by the sponsor.

8. Taxes

The winner is solely responsible for any federal, state, or local taxes that may result from accepting the prize. The Sponsor is required to report the value of the prize to tax authorities and/or obtain information from the winner as required by law.

9. Publicity

Except where prohibited by law, acceptance of a prize constitutes permission for the Sponsor to use the winner’s name, photograph, likeness, and general hometown for promotional purposes related to the Raffle without additional compensation.

The Sponsor will handle personal information in accordance with its applicable privacy policies and legal obligations.

10. Limitation of Liability

By participating in the Raffle, participants agree to release and hold harmless the Sponsor and its officers, directors, employees, volunteers, agents, and representatives from claims, liabilities, losses, damages, or expenses arising out of or related to participation in the Raffle or acceptance, possession, use, or misuse of any prize, except to the extent such limitation is prohibited by law.

11. Changes or Cancellation

The Sponsor reserves the right to modify, suspend, or cancel the Raffle when circumstances beyond its reasonable control make it necessary or when required by law. Any changes will be communicated in accordance with applicable law and, where practical, through the Sponsor’s website or other appropriate means. If such an occurrence were to happen, ticket purchase values will be reimbursed to the entrant.

12. Disqualification

The Sponsor reserves the right to disqualify any participant who:

• Violates these rules;
• Provides false or misleading information;
• Attempts to manipulate or interfere with the Raffle;
• Uses fraudulent, counterfeit, altered, or otherwise invalid tickets;
• Engages in conduct intended to undermine the integrity or fairness of the Raffle; or
• Is otherwise ineligible under applicable law.

13. Compliance With Law

The Raffle will be conducted in accordance with applicable federal, state, and local laws and regulations. If any provision of these rules conflicts with applicable law, the applicable law will prevail.

14. Official Rules

A copy of these official rules will be available at https://www.lovewvstateparks.com/outdoor-adventure-raffle/ throughout the Raffle period.

15. Acknowledgment

Timelines for prize use are established by the donating vendor. The West Virginia State Parks Foundation shall not be responsible to prize winners who do not redeem prizes within the established timeline, or in circumstances where donating vendors go out of business or refuse to honor certificates. The Foundation will not serve as a negotiator or arbiter between prize winner and donating vendor.

No refunds will be given on ticket sales for any reason.

Participation in the Raffle constitutes the participant’s acknowledgment that they have read, understood, and agreed to these Official Raffle Rules and Regulations.
